ACCEPTANCE OF TERMS

Symantec Corporation (the "Company") provides the Personal Identity Portal (as more fully described below) to you subject to the following Terms of Service ("Terms of Service"), which may be updated by us from time to time without notice to you. You can review the most current version of the Terms of Service at any time by visiting this page. You can determine when these Terms of Service were last revised by referring to the "Last Updated" legend at the bottom of these Terms of Service. You agree that your use of the Service after any such change in the terms will constitute your acceptance of the changes. In addition, when using particular Company owned or operated services, you shall be subject to any posted guidelines, rules or policies applicable to the services described herein, which may be posted by the Company from time to time. All such guidelines, rules or policies are hereby incorporated by reference into these Terms of Service.

SERVICE DESCRIPTION

The Personal Identity Portal (including the features and functions contained therein) is a free, web-based identity registration application (the "Service") provided by the Company. You understand and agree that the Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Company disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Service.

REGISTRATION FOR THE SERVICE

In consideration of your use of the Service, you represent that you are of legal age to form a binding contract and that you have read and understand these Terms of Service. You agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration process (the "Registration Data"); and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or the Company has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the Company has the right to suspend or terminate your account immediately and refuse any and all current or future use of the Services (or any portion thereof).

USE OF THE SERVICES

Subject to and conditioned upon your compliance with these Terms of Service, and solely for so long as you are permitted by the Company to use and access the Service, the Company hereby grants to you a non-exclusive, non-transferable, nonsublicensable, limited right and license to access the Service, including any images, text, graphics, videos, visuals, sounds, data, files, links and other materials incorporated into the Service (other than your Submissions), solely as made available by the Company, solely as necessary to access the Service and solely for your own personal, non-commercial, home purposes, provided that you keep intact all copyright and other proprietary notices.

You are responsible for maintaining the confidentiality of your Service password and account, and are responsible for all activities that are conducted through your account. The Company reserves the right to refuse the Service to anyone at any time without notice for any reason. You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service. Except as expressly authorized by the Company, you agree not to modify, distribute or create derivative works based on the Service, in whole or in part. The Service is designed to be used by an individual natural person, and you agree not to share use of the Service with any other person. Your use of the Service is subject to your acceptance of and compliance with these Terms of Service. You agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence. You shall not, nor shall you authorize or encourage any third party to: (i) use the Service to upload, transmit or otherwise distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable as reasonably determined by the Company; (ii) use the Service to harm minors in any way including, but not limited to, by uploading content that violates child pornography laws, child sexual exploitation laws and laws prohibiting the depiction of minors engaged in sexual conduct; (iii) upload, transmit or otherwise distribute content that infringes upon another party's intellectual property rights or other proprietary, contractual or fiduciary rights or obligations; (iv) prevent others from using the Service; (v) use the Service for any fraudulent or inappropriate purpose; (vi) attempt to upload images by any method to another user's account without permission; (vii) transmit any software or other materials that contain any viruses, worms, Trojan horses, defects, date bombs, time bombs or other items of a destructive nature; or (viii) act in any way that violates these Terms of Service, as may be revised from time to time. Violation of any of the foregoing may result in immediate termination or suspension of your use and access of the Service and/or immediate termination of these Terms of Service and, and may subject you to state and federal penalties and other legal consequences. The Company reserves the right, but shall have no obligation, to investigate your use of the Service in order to determine whether a violation of these Terms and Conditions have occurred or to comply with any applicable law, regulation, legal process or governmental request.

YOUR SUBMISSIONS

In the event that you post or upload to the Service, or otherwise submit to or through the Company as part of your use of the Service, any materials including, without limitation, photographs and other images, text, videos, audio files, data, files, and other materials (collectively, "Submissions"), you will retain ownership of such Submissions, and you hereby grant the Company and its designees a worldwide, non-exclusive, sublicenseable (through multiple tiers), assignable, royalty-free, fully paid-up, perpetual, irrevocable right to store such Submissions, solely in connection with the Service. Please note that, while you retain ownership of your Submissions, any template or layout in which you arrange or organize such Submissions through tools and features made available through the Service are not proprietary to you, and can be used by the Company and others for any purposes. You acknowledge and agree that you have no rights in any such template and/or layout, and such template or layout shall be the sole and exclusive property of the Company.

You represent, warrant and covenant that (i) you own or otherwise possess all necessary rights with respect to your Submissions, and (ii) your Submissions do not and will not infringe, misappropriate, use or disclose without authorization, or otherwise violate any intellectual property or proprietary right of any third party, and are not unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene or otherwise objectionable.

None of the Submissions will be subject to any obligation, whether of confidentiality, attribution or otherwise, on the Company's part and the Company will not be liable for any use or disclosure of any Submissions. You acknowledge and agree that the Company may (but is not obligated to) do any or all of the following, at its discretion: (a) monitor and/or filter any Submissions (including without limitation by means of blocking or replacing expletives or other language that may be deemed harmful or offensive); (b) alter, remove, or refuse to send, transmit or otherwise use any Submission (including, without limitation, by suspending the processing and shipping of any order relating to any Submission); and/or (c) disclose any Submissions, and the circumstances surrounding the transmission or use thereof, to any third party in order to operate the Services; to protect the Company and its affiliates and its and their directors, officers, employees, consultants and other agent; to comply with legal obligations, subpoenas or governmental requests; to enforce these Terms of Service; or for any other reason or purpose.

The Company is not responsible for, and will have no liability for, the removal or non-removal of any Submissions from the Service. We recommend you keep back-up copies of your Submissions on your hard drive or other personal system, as the Service is not intended to be used as a back-up solution for storing your Submissions.

MODIFICATIONS TO THE SERVICE

The Company reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that the Company shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

Registration Data and certain other personally identifiable information about you is subject to our Privacy Policy. You understand that through your use of the Service you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States and/or other countries for storage, processing and use by the Company and its affiliates.

INTERNATIONAL USE

Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical and personally identifiable information data exported from the United States or the country in which you reside.

INDEMNITY

You agree to release, indemnify, defend and hold harmless the Company, its subsidiaries, affiliates, and its and their officers, directors, shareholders, contractors, agents, employees, licensors and assigns from all liabilities, claims, damages, costs and expenses, including reasonable attorneys' fees, made by any third party due to or arising out of or in connection with (a) your use of the Service, and (b) the breach by you of your representations and warranties set forth herein.

TERMINATION

You may cancel your use of the Service and/or terminate these Terms of Service with or without cause at any time by providing written notice to the VeriSign Personal Identity Portal at our Contact Us page. However a terminated account may continue to exist for up to two business weeks before such cancellation takes effect. You agree that the Company may, under certain circumstances and without prior notice and for any reason, immediately terminate or suspend your portal account, use of and access to the Service. Causes for such termination shall include, but not be limited to, (a) breaches or violations of these Terms of Service or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the Service (or any part thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, (g) engagement by you in fraudulent or illegal activities, and/or (h) nonpayment of any fees owed by you in connection with the Service. Termination of your portal account includes (a) removal of access to all offerings within the Service and (b) barring of further use of the Service. Further, you agree that all terminations for cause shall be made in Company's sole discretion and that the Company shall not be liable to you or any third party for any termination of your account or access to the Service. In the event of termination, your account will be disabled and you may not be granted access to your account or any files or other content contained in your account although residual copies of information may remain in our system. After a period of inactivity, the Company reserves the right to disable or terminate a user's account. If an account has been deactivated for inactivity, the unique identifier(s) associated with that account may be given to another user without notice to you or such other party.

OTHER SITES

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because the Company has no control over such sites and resources, you acknowledge and agree that the Company is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

INTELLECTUAL PROPERTY RIGHTS

Except as otherwise set forth herein, all right, title and interest in and to any intellectual property, proprietary rights or other rights related to intangible property which are used, developed, comprising, embodied in, or practiced in connection with any of the Service ("Company Intellectual Property Rights") are owned by the Company or its licensors, and you agree to make no claim of interest in or ownership of any such Company Intellectual Property Rights. You acknowledge that no title to the Company Intellectual Property Rights is transferred to you, and that you do not obtain any rights, express or implied, in the Service, other than the rights expressly granted in these Terms of Service. You also agree that you will not use any robot, spider, other automated device, or manual process to monitor or copy any content from the Service.

WARRANTY DISCLAIMERS AND LIMITATIONS OF LIABILITY

YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS SOLEY AT YOUR OWN RISK AND THAT THE SERVICE IS PROVIDED ON AN "AS IS," AND "AS AVAILABLE" BASIS. YOU ACKNOWLEDGE AND AGREE THAT COMPANY SHALL HAVE NO LIABILITY TO YOU, OR TO ANY THIRD PARTY, FOR ANY MODIFICATION, SUSPENSION, DISCONTINUANCE OR TERMINATION OF THE SERVICE, OR ANY PART THEREOF. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. THE COMPANY MAKES NO WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, OR THAT THERE WILL BE NO LOSS OF DATA OR ERRORS IN TRANSMISSION. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. YOU MAY NOT RELY ON ANY SUCH INFORMATION OR ADVICE.

EXCEPT IN JURISDICTIONS WHERE SUCH PROVISIONS ARE RESTRICTED, YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE COMPANY ITS SUBSIDIARIES AND AFFILIATES AND ITS AND THEIR OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OR LOSS OF DATA, OR ERRORS IN TRANSMISSION; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS THIS SECTION MAY NOT APPLY TO YOU.

ADDITIONAL PROVISIONS

(a) Notice. The Company may provide you with notices, including those regarding changes to these Terms of Service, by email, regular mail or postings on the Personal Identity Portal website.

(b) Severability. You agree that the terms of these Terms of Service are severable. If any term or provision is declared invalid or unenforceable, in whole or in part, that term or provision will not affect the remainder of these Terms of Service; these Terms of Service will be deemed amended to the extent necessary to make these Terms of Service enforceable, valid and, to the maximum extent possible, consistent with applicable law, consistent with the original intentions of the parties; and the remaining terms and provisions will remain in full force and effect.

(c) Entire Agreement. You agree that these Terms of Service constitute the entire, complete and exclusive agreement between you and us regarding the Service and supersedes all prior agreements and understandings, whether written or oral, or whether established by custom, practice, policy or precedent, with respect to the subject matter of these Terms of Service.

(d) Assignment and Resale. Except as otherwise set forth herein, your rights under these Terms of Service are not assignable or transferable. You agree not to resell the Service or any portion thereof.

(e) Governing Law. Any disputes relating to the Services provided hereunder shall be governed and interpreted according to each of the following laws, respectively, without regard to its conflicts of law provisions: (a) the laws of the State of California, if you are located in North America or Latin America; or (b) the law of England, if you are located in Europe, Middle East or Africa; or (c) the laws of Singapore, if you are located in Asia Pacific including Japan. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Agreement.

(f) Waiver. No waiver of any provision of these Terms of Service shall be effective unless it is in writing and signed by an authorized representative of the Company. The remedies of the Company under these Terms of Service shall be cumulative and not alternative, and the election of one remedy for a breach shall not preclude pursuit of other remedies. The failure of a party, at any time or from time to time, to require performance of any obligations of the other party hereunder shall not affect its right to enforce any provision of these Terms of Service at a subsequent time, and the waiver of any rights arising out of any breach shall not be construed as a waiver of any rights arising out of any prior or subsequent breach.

(g) Headings. The section headings appearing in these Terms of Service are inserted only as a matter of convenience and in no way define, limit, construe or describe the scope or extent of such section or in any way affect such section.
